Once customs discovers goods that are suspected of infringing an intellectual property right they will detain them. The competent customs department will inform Abac-Baan of the actual or estimated quantity and the actual or supposed nature of the goods.  In many cases we will also receive samples or at least digital photographs of the goods.  If it is possible, based on this information, to conclude that the goods are counterfeit, we may confirm this to customs and we may then also receive the name and address of the consignee, consignor, the declarant or the holder of the goods and the origin and provenance of the goods suspected of infringing the intellectual property right.

In case of criminal cases (Police and Federal Service of Economy) digital photographs will also be made and if the counterfeited character is confirmed, a criminal complaint will be lodged with the public prosecutor.
